Section 9
Activities not to be done by the producer and distributor

(1) The producer or distributor shall not make any advertisement as follows- (a) promoting any product,
(b) implying or leading to the belief that bottle-feeding is equivalent to or more specific than breast-feeding.
(2) For the purpose of this section, advertisement shall mean all advertisements made under –
(a) by any publication or by television, radio, film, video or telephone,
(b) by the display of signs, billboards, notices or goods,
(c) by the exhibition of pictures or images,
(d) in any other manner.
(3) Notwithstanding anything contained in sub-section (1), the product may be advertised in publications intended for health professionals only.

But such advertisement shall be limited to factual and scientific matters and bottle feeding shall be equivalent to breast feeding or more. It should not be such as to create the belief that it is specific and such advertisement should contain the information mentioned in clause 7.
(4) The manufacturer or distributor shall not give or distribute samples of the product to anyone.
(5) A manufacturer or distributor shall not promote any product within a health care facility.
(6) For the purposes of this section, promotion means introducing a product or making a person familiar with a product by any means including the following:-
(a) By advertising,
(b) Using printed materials including books, leaflets or posters bearing the manufacturer's or distributor's name or logo or proprietary product name, symbol, graphic or other likeness,
(c) giving away or distributing for little or no value anything bearing the name or logo of the manufacturer or distributor or any proprietary product name, logo, graphic or other likeness,
(d) display the products or
(e) in any other manner.
(7) If the producer or distributor requests a grant from the health care authority or any other institution or organization in the prescribed format andUnless such demand is approved by the committee as specified, the product shall not be provided or donated to the health care agency or any other institution or organization at a price lower than the retail price.
(8) The manufacturer or distributor shall not engage with the public within the health care organization to promote their business or for such purposes.
(9) A manufacturer or distributor shall not donate any equipment or items to a health care agency without obtaining the approval of the Committee.
(10) The producer or distributor shall not give any gift or financial or other benefit to the health worker. Don't give scholarship or research grant or money needed to organize a professional seminar or conference or health workers to participate in the conference.
